Terms of service

These terms are an agreement between you and Abraham Imohiosen, Brehmstr. 25, 40239 Düsseldorf, Germany ("Daptly", "we"). By creating an account or using the app, you accept them. Our privacy policy explains how we handle your data.
1. The service
Daptly is an app for body recomposition. It gives you a daily calorie and protein target and a training plan, adjusts them from what you log, and shows the reason for each change.
2. Not medical advice
Daptly offers lifestyle guidance informed by publicly available nutrition and training research. It is not medical advice, diagnosis or treatment. Talk to a doctor before you change your diet or training if you are pregnant, have a medical condition, take medication, or have a history of eating disorders. Stop training and get medical help if you feel pain, dizziness or shortness of breath. You train at your own risk.
3. Eligibility and your account
You must be at least 16 years old. Keep your sign-in secure; you are responsible for activity in your account. You can delete your account at any time in the app, or by emailing [email protected]; see how to delete your account.
4. Free and Premium
- Free includes logging of meals, training and weight, your history, the daily plan and its adjustments, and 3 meal photo scans per day.
- Daptly Premium adds the AI coach and voice logging, and unlimited fair-use photo scans. Voice logging is limited to 300 minutes per calendar month, and to 5 minutes during the free trial.
5. Subscriptions, trial and cancellation
- Premium is sold as an auto-renewing subscription, monthly or yearly, through the App Store or Google Play. The price is shown before you buy.
- New subscribers get a 3-day free trial. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription and you are charged.
- The subscription renews automatically for the same period unless you cancel at least 24 hours before the period ends. Cancel in your App Store or Google Play account settings. Deleting the app does not cancel it.
- Payments, refunds and the statutory right of withdrawal are handled by Apple or Google under their terms. Your consumer rights under the law of your country are not affected.
6. AI features
The coach, photo scan and voice logging use AI. Their output can be wrong: check photo estimates and voice entries before you rely on them. Your targets themselves come from a fixed set of rules, not from AI.
7. Acceptable use
Do not misuse the service: no attempts to break or overload it, to access other people's data, to reverse engineer it beyond what the law allows, or to use it for unlawful purposes. We may suspend accounts that do.
8. Your content
What you log stays yours. You give us the rights we need to store and process it to run the service for you.
9. Availability and changes
We work to keep Daptly available but cannot promise it is always free of errors or interruptions. We may change features; if a change materially reduces what you pay for, we will tell you in advance.
10. Liability
We are liable without limit for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to the damage that is typical and foreseeable for this kind of contract. Otherwise our liability is excluded.
11. Changes to these terms
We may update these terms. We will tell you in the app at least 30 days before a change that affects you takes effect. If you do not agree, you can cancel before then.
12. Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not take away the protection of mandatory law of the country where you live. The EU online dispute resolution platform is at ec.europa.eu/consumers/odr. We are not obliged and not willing to take part in dispute resolution before a consumer arbitration board.
